Minutes of the First SWC Meeting held at QPMPA Office, Kochi on Sunday, 13 June 2010

The State President Dr. M. A. Koya at 11.15 a.m. called the First SWC Meeting of the QPMPA for the year 2010-11 to order at the QPMPA Office, Kochi on Sunday, 13 June 2010.

 

The State Secretary Dr. K. Kishore Kumar invested the collar. The Secretary conducted the flag salutation and silent prayer followed. Self-introduction of the members was next — 20 were present.

 

Dr. O. Baby explained the absence and illness of Dr. Bhat of Kannur and the house stood in silence praying for the fast recovery of Dr. Bhat.

 

Dr. Koya, the president welcomed the members. The president added that the strength of the association is in its bank balance and everything must be done to improve the bank balance and the membership strength. He suggested that we must think of monthly meetings in every district.

 

He opined that another attempt be made to make the IMA-QPMPA relations cordial. Many present were not optimistic and suggested that if the demand comes from IMA we can associate.

 

The president informed the house that the QPMPA awards must be revived from next year onwards and that we must honour a senior member on Doctors’ Day, every year as the one by the Government has become a private affair with stakes. The QPMPA awards are 1. Dr. C. E. Oommen Award, for Best Branch, 2. Dr. K. N. Pillai Award for Maximum Enrolment and 3. Dr. Srinivasan Award for the Best Branch President. The winners are to be given miniature trophies to take home and the main trophies to be preserved in the Central Office.

 

The minutes were not read as it was circulated and the same passed without additions or deletions.

 

Dr. Jose Mathew the Secretary of MAPS informed the house that there are 193 members in MAPS and fighting 93 cases. Most of the members in the cases have PPS coverage of the IMA and in all issues, IMA is not ready to cooperate with QPMPA in these legal battles.

 

The house requested the MAPS Secretary to arrange refund of the deposits made by senior members in MAPS like Dr. A. Cherian of Malakkara. The Secretary agreed for the same.

 

CPHA (Confederation of Private Health Care Association) Annual Conference at Amala Hospital, Thrissur came up next. Drs. M. C. Cyriac, (the Chairperson), O. Baby, A. K. Sabhapathy, N. Madhu and M. A. Koya spoke. It was decided to pay the annual contribution of Rs. 10,000 to CPHA. It was decided that all must attend the second annual meeting of CPHA and make it a success.

 

In discussions that followed Sales Tax came up first. Dr. Sabhapathy informed that we have impleaded in the case in Apex Court.

 

Minimum Wages case — The Secretary informed that the case in Kerala High Court — WP (C) 1981/2010 is posted for hearing on 15 June 2010.

 

The Drug Licence Case in Apex Court was discussed next. Dr. O. Baby, Mr. Abraham Kurien and Dr. Kishore spoke. The speakers informed the house that the case was first taken up by the Vacation Court on 7.6.2010 and it was reported that there was some unwanted discussions between the advocates of IMA and QPMPA inside the Court and the case was posted again for the next day and was admitted on 8 June 2010.


 

 

The following was the order — UPON hearing counsel the Court made the following ORDER —

 

“List after fifteen days to enable the petitioner to file additional documents.
In the meanwhile, if respondent — State so desires, may file counter affidavit.”

 


 

The three letters from the Private Hospital Board of the IMA to its members dated 5, 10 and 14 May 2010 connected with the Drug Licence SLP were circulated and discussed.

 

The Secretary informed the house that the letter dated 5.5.2010 by the IMA’s Private Hospitals Board did more harm than good to the QPMPA cause. The flow of funds for the SLP at the Supreme Court from the members has stopped abruptly as the cited letter informed the members that the IMA is fighting the case without taxing the members. Doctors’ Day celebrations: The house decided to ignore the same. The Govt. of Kerala should have published the details in January 2010 and informed the members in the Best Doctor Awards Committee. The notification for the awards to be distributed on July 1 came in the middle of May and the Committee Members were not informed as required. It was decided to ignore the state government function in this issue.

 

Also decided that the QPMPA should institute a best doctor award from next year onwards and honour senior members. The award must carry a cash prize and a citation.

 

In future plans considering the present difficulties the members face in getting many drugs, there was a discussion on starting a wholesale drug distribution by QPMPA. Drs. O. Madhu and K. Sasidharan were authorised to study the matter and present a report at the next meeting.

 

Nurses’ award was taken up next. The members disagreed, and so the idea was dropped.

 

Dr. M. A. Koya proposed that we start a daily newspaper to improve the image of the QPMPA.  He said that copies could be printed at all District Headquarters and distributed in all major towns in all districts. Dr. Koya was authorised to work out the details and inform the house.

 

Dr. Koya also proposed a mutual benefit fund for the QPMPA and the house requested him to study the feasibility and report.

 

ID card for members: Dr. Koya requested all the members to upgrade their membership to QPMPA India and to pass on the photo and details for producing the ID Cards.

 

To make QPMPA a truly national one it was decided that we start a membership campaign. Some of the members present agreed to enrol members from Karnataka, Tamil Nadu, Punjab and Delhi.

 

Dr. Baby informed the house that the membership campaign for the Cooperative Society has been started and the first 51 QPMPA Life members paying a minimum of Rs. 11,250 will be considered as founder members. As a special case, the bylaws of the Society will permit the transfer of shares of these members to non-QPMPA members.

 

Kochi Waste Energy Project was discussed next and a sigh of relief was felt in many members, as the company will take away the waste generated in hospitals free of cost.

 

Mr. Hamsa, the Director of Sylcon, a good friend of the president Dr. Koya, addressed the members next and gave a very good shoulder bag to all present as a memento.

 

After the closing remarks by the President, the Secretary Dr. Kishore Kumar proposed the vote of thanks. The President Dr. M. A. Koya adjourned the meeting at 2.00 pm for the lunch.

Minutes of the Emergency SWC Meeting held at QPMPA Office, Kochi on Sunday, 5 September 2010

Agenda — Drug Licence Case — Review Petition filed in Kerala High Court

 

 

The State President Dr. M. A. Koya at 1.45 pm called the Emergency SWC Meeting of the QPMPA to order at the QPMPA Office, Kochi on Sunday, 5 September 2010.

 

The State Secretary Dr. K. Kishore Kumar invested the collar. The Secretary conducted the flag salutation and silent prayer followed. Self-introduction of the members present was next. 42 members were present.

 

Advocate S. Sreekumar was the Chief Guest and Dr. O. Baby introduced the guest speaker.

 

Adv. Sreekumar addressed the members next and presented the various issues with the Review Petition No. 794/2010 that he was permitted to file on behalf of the QPMPA on 30 August 2010. Adv. Sreekumar informed the house that a Review Petition must be filed only before the judges who first decided the issue. Of the two judges who dismissed the QPMPA petition, one is retired and the other is in a single bench. A new divisional bench has to be constituted with the permission of the Chief Justice and all those things will take time for the completion of judicial formalities. The advocate informed the members present that the Review Petition if admitted it is as good as a stay. The members cleared all doubts.

 

Dr. O. Baby then gave a chronological account of the case from the date of dismissal of the case by the High Court on 25 March 2010. Drs. M. C. Cyriac,  Sajan and others spoke on the issue.

 

By then the Manorama News Channel crew appeared at the meeting venue and they interviewed the President Dr. M. A. Koya, Dr. Joseph Stephen of Thodupuzha and Dr. Ranjendran of Kozhikode who were humiliated by a raid from the Drugs Department.

 

The members present actively participated in the discussions and the President adjourned the meeting at 4 pm after the vote of thanks by the Secretary.
